This Privacy Policy ("Policy") for EDGEX DAO INC ("Company", "we", "our", or "us") describes the basis on which we may process personal data we may collect from users of the "Site" (as defined below), in accordance with applicable law. For purposes of applicable data protection laws, the "Company" is the controller. For the purposes of this "Policy", "you" and "your" refers to you as the user of the "Site".

"Site" means edgeX's websites, including edgeX.exchange (and their respective subdomains); web applications; mobile applications; and all associated sites linked thereto by edgeX (collectively with any materials and services available therein, and successor website(s) or application(s) thereto). This "Policy" applies to all interactions with the "Site", whether initiated by a natural person or an autonomous software agent ("AI Agent").

To ensure transparency regarding our decentralized operations, please note the following roles:

  • Service Provider: The website and user interface are technically provided and maintained by edgeX Infra Corporation. In this capacity, edgeX Infra Corporation acts solely as a Data Processor.
  • Data Controller: Decisions regarding the collection and use of personal data are made by the EDGEX DAO INC, which is the primary Data Controller.
Read this Policy carefully so that you understand your rights. If you do not agree to this Policy, do not use, access, connect to, or interact with the Site.

1. PERSONAL DATA WE COLLECT ABOUT YOU

When you access, use, connect to, or interact with the Site, we may collect certain categories of information, including personal data, from a variety of sources.
  • "Wallet" Information: Data may include: (i) any digital-asset, smart-contract, or protocol address ("Wallet") information; and (ii) geolocation data. You provide this data to us when you connect your Wallet to the Site.
  • "On-Chain History": Other data may include transaction data or history (such as your public blockchain transaction history and other information associated with a linked address or Wallet and token holdings).
  • "Communication Data": Should you contact us, we will collect the content of the communications and any personal data contained within, including the email address used.
  • "Usage Data": Our servers may automatically save access details in a log file, including: (i) date and time of access; (ii) country of access; (iii) API endpoints accessed; (iv) user agent details; and (v) operating system/browser version.

2. THIRD-PARTY SERVICES AND DISCLAIMER

The Site relies on external, decentralized, and third-party services that the Company does not own or control.
  • Oracles & Nodes: These include decentralized price oracles (e.g., Chainlink) and blockchain node providers.
  • Wallets: Features of the Site require you to connect a compatible third-party Wallet (e.g., MetaMask). Your interactions with these Wallets are governed by their respective privacy policies.
  • Disclaimer: We expressly disclaim any liability for actions arising from your use of third-party services, including those relating to the disclosure of personal information by such providers. We may provide links on the Site to other websites or online platforms operated by third parties. If you follow those links to sites not owned or operated by us, you should review their available privacy and security policies and other terms and conditions. do not guarantee and are not responsible for the privacy, security, or content of these sites, including the accuracy, completeness, or reliability of information and services found on these sites.

3. LEGAL BASIS FOR PROCESSING PERSONAL DATA

We process your personal data only when we have a valid legal basis to do so under applicable data protection laws. These bases include:
  • Contractual Necessity: We process data that is strictly required to fulfill our agreement with you. This includes using your wallet address to facilitate your interaction with the Site, execute trades on the EDGE Chain, and manage liquidations.
  • Legitimate Interests: We process data for our balanced business interests, provided they do not override your fundamental rights. This includes Security & Stability (troubleshooting and data analytics to ensure system performance) and Fraud Prevention (using technical identifiers to block malicious actors or DDoS attacks).
  • Legal Compliance: We process data when necessary to comply with our statutory obligations, such as identifying if you are a "Restricted Person" as defined in the Terms of Use.

4. ADDITIONAL DISCLOSURES FOR EEA AND UK USERS

4.1 Roles: For the purposes of the GDPR and the UK GDPR, EDGEX DAO INC is the Data Controller. edgeX Foundation and edgeX Infra Corporation are not controllers of, and have no access to, this data.
4.2 International Transfers: Your data may be transferred to, and processed in, jurisdictions outside of the EEA and the UK where our infrastructure providers are located. To ensure your data remains protected when it leaves high-protection zones, we adopt Standard Contractual Clauses ("SCCs") for this purpose.

5. SHARING OF PERSONAL DATA

We may share your information with:
  • Service Providers: Blockchain analysis providers, screening services (for geo-blocking), and data analytics providers.
  • Professional Advisors: Legal or financial advisors in our legitimate interests.
  • Legal & Security: To protect the Site or comply with legal obligations, including "HKIAC" arbitration proceedings.

6. RETENTION & BLOCKCHAIN IMMUTABILITY

  • Off-Chain: We retain data only as long as necessary to fulfill the purposes for which it was collected.
  • On-Chain: IMPORTANT. Information committed to the EDGE Chain (e.g., Wallet addresses, transaction hashes, liquidations) is decentralized and immutable. The Company cannot delete or "forget" data recorded on the blockchain.

7. YOUR RIGHTS

Under applicable data protection laws, you may have the right to: access, portability, correction, or erasure of your personal data (subject to Section 6), and the right to object to processing. To exercise these rights, submit a request to [email protected].

8. COOKIE POLICY

We use strictly necessary cookies to ensure compliance with the Terms of Use and to remember your Wallet connection. We do not use tracking cookies for third-party advertising.

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1 Incorporation of Terms: This Policy is incorporated into and is subject to the edgeX Terms of Use. Any dispute, controversy, or claim arising out of or relating to this Policy, including the validity, invalidity, breach, or termination thereof, shall be resolved in accordance with the Governing Law and Arbitration procedures set forth in the Terms of Use.

9.2 Binding Arbitration: You agree that any dispute related to your personal data or privacy rights shall be submitted to binding, individual arbitration at the HKIAC in Hong Kong, including the Small Claims Procedure for eligible disputes, as detailed in the Terms of Use.

10. AFFILIATE PROTECTION

10.1 Third-Party Beneficiaries: While this Policy is issued by EDGEX DAO INC, you acknowledge that the Site is supported by technical contributions from edgeX Infra Corporation. Accordingly, edgeX Infra Corporation and its affiliates are intended third-party beneficiaries of this Policy. Any protections, disclaimers, or limitations of liability afforded to the Company herein shall apply with equal force to edgeX Infra Corporation in the event of any claim arising from your use of the Site or the processing of your data.

11. MISCELLANEOUS

11.1 Entire Agreement: This Policy, together with the Terms of Use, constitutes the entire agreement between you and the Company regarding your privacy and personal data.

11.2 Severability: If any provision of this Policy is found by an arbitrator or court of competent jurisdiction to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remainder of the Policy shall otherwise remain in full force and effect.

11.3 No Waiver: No waiver by the Company of any term or condition set forth in this Policy shall be deemed a further or continuing waiver of such term or condition.

11.4 Assignment & Business Transfer: The Company may assign its rights and obligations under this Policy in the event of a merger, acquisition, reorganization, or sale of assets. You may not assign your rights under this Policy without our prior written consent.

12. PERIODIC REVIEWS AND UPDATES TO POLICY

We may review and update this Policy from time to time. Updates to this Policy will apply only to information collected after the date of the change. If we make material changes, we will update the "Last updated" date at the top of this Policy.
